Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Scaffold platform (“Scaffold”, “we”, “us”), including all websites, applications, courses, and AI features we provide. By creating an account or using Scaffold, you agree to these Terms. If you do not agree, do not use Scaffold.

1. Eligibility and accounts

You must be at least 13 years old to create an account. You are responsible for the accuracy of the information you provide and for keeping your password confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any suspected unauthorized access.

2. Subscriptions, payment, and refunds

Some features (collectively “Pro”) require a paid subscription. Subscription fees are billed in advance through our payment processor (Stripe) and renew automatically until you cancel. You may cancel at any time from the billing portal; your access continues until the end of the current billing period. Except where required by law, payments are non-refundable, including for partial periods of service, accounts terminated for cause, or unused features.

3. Acceptable use

You agree not to:

  • Use Scaffold to violate any law, regulation, or third-party right, or to send unlawful, infringing, harassing, or harmful content.
  • Attempt to gain unauthorized access to the platform, other accounts, or our infrastructure, or interfere with the operation of the service.
  • Scrape, copy, redistribute, or resell course content, including lessons, quizzes, and AI-generated responses, without our written permission.
  • Share, transfer, or resell your account credentials.
  • Use automated tools to interact with the platform in a way that imposes an unreasonable load.

4. AI tutor — usage and abuse

Scaffold provides an AI tutor that uses third-party large language models (“LLM”) to answer questions about course material. The AI tutor is offered on a fair-use basis and is subject to per-account rate limits. We log every AI tutor request, including the prompt you submit and the response generated, in order to operate the service, monitor for abuse, and improve safety.

The following constitute abuse of the AI tutor and are grounds for immediate suspension or termination of your account without refund:

  • Evading or attempting to evade rate limits (for example by creating multiple accounts, using automation, or rotating IP addresses).
  • Submitting prompts intended to bypass system instructions, extract the system prompt, or jailbreak the model.
  • Using the AI tutor to generate content unrelated to your enrolled courses, including homework or work for third parties.
  • Bulk extraction, scraping, or commercial redistribution of prompts, responses, or course context delivered to the model.
  • Submitting content that is illegal, defamatory, harassing, or otherwise prohibited by section 3.

If we determine, in our sole reasonable judgment, that your activity constitutes abuse, we may suspend or terminate your access at any time, with or without notice, and you will not be entitled to a refund of any prepaid fees. We may also throttle, queue, or temporarily disable AI features at any time without liability.

5. Content and intellectual property

All course content, designs, trademarks, and software on Scaffold are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access course material for your personal, non-commercial learning while your account is in good standing.

You retain ownership of content you submit (e.g., notes, prompts). You grant us a worldwide, royalty-free license to host, store, process, and use that content as needed to provide and improve the service, including sending prompts to LLM providers as described in our Privacy Policy.

6. Disclaimers

Scaffold and the AI tutor are provided “as is” and “as available”. AI responses may be inaccurate, incomplete, or out of date and should not be relied upon for professional, medical, legal, or financial advice. We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the maximum extent permitted by law, Scaffold and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the service. Our aggregate liability for any claim relating to the service will not exceed the greater of (a) the amounts you paid us in the twelve months before the claim, or (b) one hundred US dollars.

8. Termination

You may close your account at any time. We may suspend or terminate your access at any time if you violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, and dispute resolution) will survive.

9. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will provide reasonable notice (for example by email or by an in-product notice). Continued use of Scaffold after the effective date constitutes acceptance of the updated Terms.
